Patent:

The following documents are required to be submitted for the registration of patent along with the application:

Name, address, occupation of the person or the firm/company of inventor of the patent.
If the applicant is not the inventor of the patent, the document giving right to the applicant by the inventor.
The method of using or operating of making of such patent.
If such patent is based on any specific principal or formula, such principal or formula.
Application for the registration of Patent.
Foreign registration certificate.

Time from filing to registration : Normally six months to one and a half years.
Registration Duration: 7 years from registration date.
Renewal Duration: 7 years.
Claiming priority under Paris Convention : yes
Renewal Application: Within 35 days before expiry

Design:

The following documents are required to be submitted for the registration of Design along with the application:

Name, address, occupation of the person or the firm/company of the design.

If the applicant is not the designer of the design, the document giving right to the applicant by the designer.

Statement including map and design (drawings)

Four copies of the drawings

Application for the registration of a design.

Foreign registration certificate.

Note: Time from filing to registration : Normally 1 month to 6 months.
Registration Duration: 5 years from registration date.
Renewal Duration: 5 years.
Renewal Application: Within 35 days before expiry

It may take at least 3 months to 3 years to issue the registration certificate of Patent/Design after the application (with complete documents and fee) has been submitted to the Department of Industries.

If foreign registration certificate has been submitted along with the application the registration time may take only few months.

Foreign Registration Certificate:

Foreign registration (i.e. the registration in any foreign country) certificate is a must to register any foreign Patent/Design in Nepal . Please send a notarized photocopy of the foreign registration certificate. We require notarized photocopy of the foreign registration certificate for each class for each Patent/Design. If the certificate has been issued in language other than English (for example Chinese, Japanese) it should be accompanied by English translation certified by Notary Public.

Power of Attorney:

Power of Attorney in favor of Apex Law Chamber granting express authority to sign related application and/or appoint representative in the matter of registration of the said Patent/Design should be sent to us along with the other documents. There is no specified format of the Power of Attorney. We can provide the format commonly used in Nepal for this purpose on request. However, Notary Public should certify the Power of Attorney.
